“DPP Phiri Urges Prosecutors to Adopt Alternative Dispute Resolution.”
Director of Public Prosecutions Gilbert Phiri has directed prosecutors to embrace alternative dispute resolution mechanisms in deserving cases to facilitate the swift disposal of criminal cases.
Mr. Phiri emphasized the need for innovative mechanisms, citing the overwhelming number of inmates—over 26,000 countrywide—housed in merely 87 correctional facilities.
He noted that this constitutes a clear violation of human rights, both nationally and internationally.
The Director of Public Prosecutions made these remarks during the ceremonial opening of the High Court criminal sessions for Northern Province in Kasama District.
The event was held under the theme “Exploring and Imploring Alternative Disputes Resolution Mechanisms in Criminal Cases as a Tool to Counter Delays in the Delivery of Justice.”
Mr. Phiri expressed his disappointment with the country’s retributive criminal justice system, which prioritizes punishment over rehabilitation.
He advocated for a shift towards alternative dispute resolution mechanisms.
However, Mr. Phiri acknowledged the challenges faced by the national prosecution authority and the judiciary, including inadequate staffing and courtroom facilities.
He noted that this has led to prolonged pre-trial detentions, underscoring the need for alternative dispute resolution mechanisms.
Meanwhile, Justice Matthew Zulu, in charge of the High Court at Kasama, echoed Mr. Phiri’s sentiments, emphasizing the importance of a dynamic approach to addressing delays in the delivery of justice by involving all stakeholders in the justice system.
Justice Zulu highlighted the need to maximize the application of legal provisions that allow for non-traditional means of disposing of cases, thereby alleviating delays.
He cited alternative dispute resolution as a key strategy.
The event was being attended by Northern Province Minister Leonard Mbao, His Royal Highness Paramount Chief Chitimukulu Kanyanta Manga II, and other government officials.
